Terms of Service

1. Acceptance of Terms

By creating an account or using Pheme ("Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Service. You must accept these Terms during registration by checking the acceptance checkbox.

2. Description of Service

Pheme is a SaaS platform that monitors and analyzes brand visibility across AI search engines, including ChatGPT, Perplexity, Google AI Mode, Google AI Overviews, Gemini, Copilot, Claude, and Seznam AI. The Service provides:

• AI search engine scanning and brand mention tracking
• Visibility scoring and sentiment analysis
• Technical site audits for AI readiness
• Content recommendations and task generation
• Competitive analysis across AI platforms

3. User Accounts

To use the Service, you must create an account. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use at security@phemeapp.com

4. Subscriptions and Payments

• The Service offers free and paid subscription plans
• Paid plans are billed monthly or annually through Stripe
• You may cancel your subscription at any time; access continues until the end of the billing period
• Refunds are handled on a case-by-case basis within 14 days of purchase
• We reserve the right to change pricing with 30 days advance notice

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or its infrastructure
• Scrape, copy, or redistribute data from the Service without permission
• Use the Service to manipulate AI search engine results
• Share your account credentials with unauthorized third parties
• Exceed the usage limits of your subscription plan
• Use automated tools to access the Service beyond provided APIs

6. Usage Limits

Each subscription plan has defined usage limits including scan frequency, number of monitored prompts, AI analysis requests, and content generation. Exceeding these limits may result in temporary service restriction until the next billing period.

7. Data Ownership

• Your data: You retain all rights to data you input (brand names, domains, prompts). AI scan results generated for your account are available to you under your subscription.
• Our data: Aggregated, anonymized insights derived from all users remain our property and may be used for product improvement.
• Export: You may export all your data at any time via Settings → Security → Export.
• Deletion: You may delete your account and all data at any time via Settings → Security → Delete Account.

8. Intellectual Property

The Service and its original content, features, algorithms, and functionality are owned by Pheme and are protected by international copyright, trademark, and other intellectual property laws. AI engine logos and names are trademarks of their respective owners.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Specifically:

• We do not guarantee the accuracy of AI scan results, as AI engine outputs are non-deterministic
• We do not guarantee uninterrupted or error-free service
• AI visibility scores are indicative and may vary between scans

10. Limitation of Liability

To the maximum extent permitted by law, Pheme shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service, including but not limited to lost profits, business interruption, or data loss.

11. Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for material changes that affect your use.

12. Termination

We may terminate or suspend your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. You may request data export before termination.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify registered users of material changes via email at least 14 days in advance. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic. Any disputes shall be resolved by the competent courts of the Czech Republic.
